Swim Swift

General Terms and Conditions

1. Registration

  1. Registrations must be submitted in writing via the registration form on the website or by e-mail.
  2. Registration becomes binding once Swim Swift sends written booking confirmation.
  3. Unless communicated otherwise, follow-up courses are booked automatically. If no written cancellation is received by the communicated deadline, the follow-up course is considered binding.
  4. Swim Swift reserves the right to cancel or postpone courses if the minimum number of participants is not reached. In this case, participants incur no costs.
  5. If the maximum number of participants is exceeded, a waiting list is maintained.
  6. Course location and final course time are confirmed in writing by e-mail.

2. Course Confirmation and Payment

  1. A complete address must be provided for issuing the course confirmation.
  2. The course confirmation is binding.
  3. The invoice must be paid within 30 days from the invoice date.
  4. In case of late payment, a reminder fee of CHF 20 is charged per reminder.
  5. Swim Swift reserves the right to exclude participants with outstanding invoices from lessons or to block future bookings.
  6. Swim Swift reserves the right to adjust prices up to issuance of the course confirmation.

3. Missed Lessons

3.1 Group Courses

  • Missed lessons generally do not entitle participants to refunds or rescheduling.
  • In case of illness or accident, lessons may be made up provided that a valid medical certificate is submitted, notification is made within 72 hours, and free spots are available.
  • No refunds are granted.

3.2 Private Flex Lessons

  • Lessons cancelled at least 24 hours in advance may be rescheduled.

4. Course Cancellation

General

  • Course cancellation must be made in writing by e-mail.
  • Non-payment of the course fee does not constitute cancellation.
  • Swim Swift generally does not provide cash payouts.

4.1 New Registrations

  • For new registrations, cancellation is possible up to 30 days before course start. In this case, the course invoice is cancelled.
  • If cancellation occurs less than 30 days before course start, the full course fee is due.

4.2 Automatic Follow-up Bookings

  • Follow-up courses are booked automatically unless a written cancellation is received by the communicated deadline.
  • After this deadline, the course is considered bindingly booked.
  • For automatically booked follow-up courses, there is no additional right of withdrawal 30 days before course start.
  • In case of later cancellations, a processing fee of CHF 70 may be charged if the course spot can be reassigned.
  • If the course spot cannot be reassigned, the full course fee remains due.

4.3 Illness or Accident

  • In case of prolonged absence due to illness or accident, a pro rata credit may be granted upon submission of a medical certificate.
  • This credit is issued as a non-transferable voucher.
  • The voucher is valid for 12 months.

5. Private Flex Lessons

  1. Lessons cancelled at least 24 hours in advance may be rescheduled.
  2. Lessons cancelled or rescheduled less than 24 hours before start are charged in full.

6. Insurance and Liability

  1. Participation in swimming lessons is at the participant’s own risk.
  2. Participants or their legal guardians are responsible for adequate insurance coverage.
  3. Swim Swift is not liable for damages occurring during swimming lessons, except in cases of gross negligence or intent.

7. Force Majeure

  1. If indoor pools cannot be used due to circumstances outside Swim Swift’s control (e.g. closure, technical failure, natural events, or official orders), there is no entitlement to refunds or lesson rescheduling.

8. Safety and Responsibility

  1. Parents or legal guardians are fully responsible for their children before and after swimming lessons.
  2. Swim Swift’s responsibility begins at the start of the lesson and ends at the end of the lesson.

9. Swimming Materials

  1. Appropriate swimwear is mandatory for all participants.
  2. Swimming aids (e.g. floaties or swim vests) are not permitted during lessons.
  3. Swimming goggles may be used from level 3 onward. In exceptional cases, prior agreement with Swim Swift is required.

10. Jurisdiction

Swiss law applies exclusively. Place of jurisdiction is Dübendorf, Switzerland.
